End User License Agreement — XSN Archive Viewer

This End User License Agreement ("Agreement") is between Aphex Coding, Bartlomiej Rakuzy Aphex Coding, Morska 139/6, 81-222 Gdynia, woj. pomorskie, Poland, tax ID (NIP) 8862855318 ("we", "us"), and you ("you"). If you accept this Agreement on behalf of a company or other organization, "you" means that organization, and you confirm that you are authorized to bind it.
By installing or using XSN Archive Viewer you accept this Agreement. If you do not accept it, do not install or use the Software.
1. Definitions
- Software — the XSN Archive Viewer application for Windows (window and command-line programs), its updates and its documentation, however obtained (Microsoft Store or our website).
- Trial Mode — the Software used without an activated License Key.
- License — the paid right described in section 4, purchased for a one-time fee.
- License Key — the key you receive after buying a License.
- Licensed Computer — a computer on which the License Key is currently activated.
- Output — PDF, HTML, CSV, attachment and report files the Software creates from your files.
- Consumer — a natural person who accepts this Agreement for purposes outside their trade, business, craft or profession, and any other person whom the mandatory law of their country protects as a consumer in this Agreement (in Poland this includes a sole trader for whom the Agreement is not of a professional nature).
2. Free download and Trial Mode
The Software is offered free of charge. You may install it on any number of computers. If you obtained it from the Microsoft Store, installation is also governed by the Microsoft Store usage rules.
In Trial Mode all features are available with two limits: only the first 10 forms of each run are converted, and PDF and HTML Output carries a "TRIAL VERSION" watermark. Forms beyond the limit are listed in the report as skipped. Trial Mode has no time limit, requires no registration and no internet connection, and you may use its Output for any lawful purpose.
3. Ownership
The Software is licensed, not sold. We and our licensors keep all rights, title and interest in the Software. You receive only the rights expressly granted in this Agreement.
4. The paid License
Subject to this Agreement and to payment of the fee, we grant you a perpetual, non-exclusive, non-transferable (except as stated below) license to use the Software without the Trial Mode limits:
a) Up to 3 Licensed Computers at a time. You may activate one License Key on up to three (3) computers at the same time. You may move the License to another computer by deactivating it on a Licensed Computer (button Deactivate or ipa license deactivate) and activating it on the new one. If a Licensed Computer is lost or broken, write to us and we will release that activation.
b) Who may use it. The Software may be used on the Licensed Computers by you and, if you are an organization, by your employees and contractors, for your purposes, including processing forms on behalf of your clients.
c) This limit applies only to the License Key. The limit of three computers concerns activations of a License Key bought outside the Microsoft Store. It does not limit how many computers may install the free Software or use it in Trial Mode.
d) No subscription. The fee is paid once. There are no recurring charges.
5. Activation and license checks
Activating a License Key requires an internet connection once. After that the Software works offline. While a License is active, the Software re-checks it with the license server about every 14 days when a connection is available; a missing connection never disables the License. If the License has been refunded, cancelled or charged back, or is no longer activated on that computer, the Software returns to Trial Mode. The data sent during activation and checks is described in our Privacy Policy at https://xsn.aphexcoding.tech/privacy.
6. Purchase, reseller and refunds
a) Who sells the License. Licenses are sold by Freemius, Inc. (USA), our authorized reseller and merchant of record. Your purchase contract is with Freemius: Freemius issues the invoice, collects payment and any applicable sales tax or VAT, and the terms Freemius presents at checkout apply to the purchase and payment. The price is shown at checkout. The Microsoft Store does not sell the License and is not involved in the payment.
b) This Agreement and the Freemius terms. This Agreement governs your use of the Software and your relationship with us. The Freemius terms govern your relationship with Freemius. Nothing in the Freemius terms reduces the rights this Agreement gives you against us.
c) 14-day refund, no questions asked. You may ask for a full refund within 14 days of purchase, for any reason, through the Freemius customer portal or by writing to support@aphexcoding.tech. Downloading, installing or activating the Software does not affect this right. The refund is paid by Freemius. After a refund the License Key is cancelled and the Software returns to Trial Mode.
d) Consumers. If you are a Consumer, your statutory rights — including the right of withdrawal and your rights if the Software does not conform to the contract — are not affected by this Agreement. The refund in section 6(c) is given in addition to those rights and is not subject to any condition.
7. Updates and support
a) We may provide updates; in the Microsoft Store version they are delivered by the Microsoft Store. Your License Key works with all updates of the Software that we publish. We are not obliged to provide new features. If you are a Consumer, we will provide the updates, including security updates, that the law requires to keep the Software in conformity with the contract.
b) Support is provided by e-mail at support@aphexcoding.tech, in English, on a reasonable-efforts basis. There is no guaranteed response time, except that we answer complaints from Consumers within 14 days of receiving them.
8. Restrictions
You must not:
a) remove, bypass or disable the Trial Mode limits, the watermark or the license check, or help others do so;
b) share, publish, sell, rent or sublicense a License Key, or activate it on more computers than allowed;
c) reverse engineer, decompile or disassemble the Software, except to the extent that applicable law permits it despite this restriction (for example to observe, study or test how the Software works, or to achieve interoperability, as allowed by the EU Software Directive), and except as allowed in section 10;
d) remove copyright, trademark or license notices from the Software;
e) use the Software to break the law or to infringe the rights of others.
Removing the watermark from Output created in Trial Mode by editing the files is not permitted; buy a License and convert the forms again instead (the Software re-prints watermarked PDFs automatically after activation).
9. Your files, your data and the Output
a) The Software processes your forms, templates and attachments only on your computer. We do not receive them.
b) You are responsible for having the right to process the files you convert and for complying with data protection law with regard to personal data contained in them. For that processing you (or your organization) are the controller; we are not a processor of that data.
c) The Output belongs to you. We claim no rights in it.
d) Check the Output before you rely on it. The Software reproduces forms as they were saved; it does not run form rules or code, does not verify digital signatures and cannot read data that was only available from live data connections (see "Known limitations" in the documentation). Before you delete or stop keeping the original files, check that the Output meets your needs and any record-keeping obligations.
10. Third-party components
The Software includes open-source components, each licensed under its own terms, which are listed with their license texts in the file THIRD-PARTY-NOTICES.txt supplied with the Software. Nothing in this Agreement limits your rights under those licenses. If the Software includes a component licensed under the GNU Lesser General Public License, you may modify that component for your own use and reverse engineer the Software to the extent needed to debug such modifications, and you may request the source code of that component at support@aphexcoding.tech.
The Software uses Microsoft Edge or Google Chrome already installed on your computer to print PDFs. Those browsers are not part of the Software and are governed by their own terms.
11. Trademarks and independence
XSN Archive Viewer is an independent product of Aphex Coding. It is not affiliated with, sponsored or endorsed by Microsoft. Microsoft, InfoPath, SharePoint, Windows and Microsoft Edge are trademarks of the Microsoft group of companies. Google Chrome is a trademark of Google LLC. Other names are used only to describe compatibility.
12. Microsoft and Freemius
This Agreement is between you and us only. Microsoft Corporation is not a party to it and is not responsible for the Software, its support or any claims relating to it; the Microsoft Store terms govern your use of the Microsoft Store itself. Freemius, Inc. is not a party to this Agreement; its role is described in section 6.
13. Warranty
a) We will make reasonable efforts to keep the Software working as described in its documentation.
b) If you are not a Consumer: because Trial Mode lets you test the Software on your own forms before buying, and you can get a refund within 14 days, the Software is otherwise provided "as is", without other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.
c) If you are a Consumer, you keep all your statutory rights for digital content that does not conform to the contract; section 13(b) does not apply to you.
14. Limitation of liability
a) If you are not a Consumer, and to the extent permitted by law, we are not liable for indirect or consequential damages, lost profits, lost data or business interruption.
b) If you are not a Consumer, and to the extent permitted by law, our total liability under this Agreement is limited to the amount you paid for the License, or USD 10 if you use the Software only in Trial Mode.
c) If you are a Consumer, we are liable under the mandatory law of your country of residence, and sections 14(a) and 14(b) apply only to the extent that law allows.
d) Nothing in this Agreement limits liability for damage caused intentionally or by gross negligence, for death or personal injury, under product liability law, or any other liability that cannot be limited under applicable law.
15. Term and termination
This Agreement applies for as long as you use the Software. It ends automatically if you materially breach it and do not cure the breach within 14 days after our notice; then you must stop using the Software and the License Key is cancelled. We will not terminate a paid License for any other reason. Sections 3, 8, 9, 12, 14, 16 and 17 survive termination.
16. Export and sanctions
You must comply with export control and sanctions laws that apply to you. You may not use the Software if you are located in, or are a resident of, a country or region subject to comprehensive EU or US sanctions, or are on a sanctions list.
17. Governing law and disputes
This Agreement is governed by Polish law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are not a Consumer, disputes will be resolved by the court having jurisdiction over our registered place of business. If you are a Consumer, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings in the courts of your country of residence.
18. Changes to this Agreement
We may update this Agreement for new versions of the Software, for example to reflect new features or changes in the law. Changes do not reduce the rights you have already paid for under a License without your consent. The current version is available at https://xsn.aphexcoding.tech/eula, with its effective date.
19. Miscellaneous
If any provision is found unenforceable, the rest remains in effect. This Agreement, together with our Privacy Policy, is the entire agreement between you and us about the Software. This Agreement is written in English; translations are for information only, except where the mandatory law of a Consumer's country requires otherwise.
